Acceptance of Terms
By engaging Evergro Landscapers (Pty) Ltd (“Evergro,” “we,” “us”) for an estimate, booking a service, or making a payment, you (“Client,” “you”) agree to be bound by these Terms and Conditions. These terms, together with any specific estimate or proposal provided, constitute the entire agreement between us.
Estimates & Agreements
All estimates and proposals are valid for 30 days from the date of issue. A booking is considered confirmed, and a contract formed, upon your written acceptance of our estimate/proposal and the payment of any required deposit as specified therein.
Pricing & Payment Terms
One-Off Projects: A 50% deposit is required to schedule the work. The remaining balance will be structured as 25% at a predetermined project milestone and the final 25% upon completion, unless otherwise agreed in writing.
- Recurring Maintenance Plans: Fees are payable monthly in advance. An invoice will be issued around the 25th of each month for the following month’s service. Payment must be received before the 1st of the service month, or services may be suspended until payment is made. Alternative arrangements must be agreed upon in writing in advance.
- All prices are quoted in South African Rand (ZAR) and are exclusive of VAT unless stated otherwise.
Scheduling, Access & Cancellations
- You agree to provide safe and unobstructed access to the property on the scheduled date(s).
- One-Off Jobs: Require at least 24 hours’ notice to reschedule. Rescheduled work will be booked for our next available date.
- Recurring Work: Requires at least one week’s notice to request a change to your regular service day/time, subject to availability. If your preferred alternative time is unavailable, an after-hours service may be offered at an additional overtime fee.
- Failure to provide access for a scheduled service without sufficient notice may result in a cancellation fee.
Client Responsibilities
You warrant that you are the property owner or have the necessary authority to instruct us to perform work on the property. You are responsible for disclosing any potential hazards (e.g., underground utilities, irrigation lines, weak structures).
Limitation of Liability
- Our total liability to you for any claim arising from our services, whether in contract or delict (tort), shall be limited to the total value of the services rendered under the specific agreement.
- For recurring maintenance plans, liability is limited to an amount not exceeding six months’ worth of service fees.
- We shall not be liable for any pre-existing conditions of your lawn, garden, or property, or for damage resulting from factors beyond our reasonable control.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation for a period of 14 days. Intellectual Property
Any landscape designs, plans, or drawings created by Evergro Landscapers remain our intellectual property until fully paid for. We may use photographs of completed projects for our portfolio and marketing purposes, unless you expressly request otherwise in writing.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.
Privacy
Your personal information will be handled in accordance with our Privacy Policy, which forms part of these Terms.
